What is the warranty procedure?

  • The payment of all the expenses originated by discharge of complaints and ordinary appeals and of replacement against sanctions due to infractions of the Law on Traffic, Circulation of Motor Vehicles and Road Safety RDL 6/2015, and other traffic regulatory provisions, which are attributed to the INSURED and which may carry financial penalties or deprivation of the driving license. The Insurance Entity may be in charge of the liquidation of the corresponding sanction , if the INSURED requests it and makes the necessary provision of funds to pay the penalty.
  • The OWNER and DRIVER OF THE INSURED VEHICLE is considered INSURED.

How do I use this service ?

  • This service will be provided by ARAG, a company specialized in Legal Defense.
    • When a fine is communicated, the INSURED has the following options: Access your account at https://cleverea.com, from where you can request ar the fines management service.
    • Call +34 932 209 842, where you will receive appropriate instructions.
    • Send an email to siniestros@cleverea.com, requesting the service of management of fines.
  • The INSURED must have the receipt of the premium of their Automobile Insurance that justifies that it is in force, the communication of the fine and the envelope in that you are notified of the same.
  • THE BULLETIN OF COMPLAINT OR NOTIFICATION OF THE SANCTION, AS WELL AS THE ENVELOPE CONTAINING IT, MUST BE SENT TO CLEVEREA OR TO THE INSURANCE ENTITY WITHIN A MAXIMUM PERIOD OF 15 DAYS.

What does the Fines Resource Management coverage not cover?

In addition to the general exclusions of voluntary guarantees, the following are excluded from this guarantee:

  • Fines or sanctions imposed by any public authority.
  • The benefits of the Insurance Company will be limited to administrative procedures, expressly excluding any other judicial procedure.

What does the Fines Alert Management coverage cover?

  • As a complement to the guarantee of Defense in Administrative Traffic Offenses, ARAG will periodically monitor the Traffic Sanctions Board (TESTRA), as well as in the different electronic bulletins of Organizations Spanish officials at the provincial, regional or national level, in order to locate the administrative traffic sanctions that may have been imposed on the Insured.
  • In case of location of said sanctions, ARAG will inform the Policyholder by email or SMS, provided that it has provided the necessary data to carry out said communication.
  • ARAG is not responsible, in any case, for events beyond its control, such as errors, delays, illegibility or data from insufficient identification, nor the adequate functioning of the technological systems of official bodies and / or those required for the transmission of communications.

¿Qué es la cobertura de Accidente al Conductor?

Con la responsabilidad civil cubrimos los daños que puede causar el asegurado a un tercero en un accidente de tráfico. Por otro lado, la cobertura de Accidente al Conductor cubre al asegurado en caso de sufrir él en el accidente daños personales. Esta cobertura te protege a ti cuando no hay un tercero culpable del siniestro.

¿Qué cubre la cobertura de Accidente al Conductor?

Se entiende por ASEGURADO al CONDUCTOR del VEHÍCULO asegurado en el momento del accidente.

Muerte:

  • El capital asegurado en caso de fallecimiento del asegurado producido dentro del plazo de dos años como consecuencia de un accidente ocurrido con la moto asegurada.
  • En caso de no existir declaración expresa de los Beneficiarios por parte del ASEGURADO o no se pudiera hacer efectivo el pago de la indemnización a estas personas, los Beneficiarios serán los siguientes en función del orden establecido:
    • El cónyuge no separado legalmente.
    • Los hijos por partes iguales.
    • Los padres
    • Los hermanos
    • Los herederos

    Invalidez permanente:

    • El capital asegurado en caso de invalidez permanente del asegurado producida dentro del plazo de dos años como consecuencia de un accidente ocurrido con la moto asegurada.
    • La determinación del grado de invalidez que derive del accidente se efectuará después de la presentación de los informes médicos que permitan determinar el grado de invalidez y de acuerdo con la valoración de las secuelas de la tabla 2.A.1 del Anexo del texto refundido de la Ley sobre Responsabilidad Civil y Seguro en la Circulación de Vehículos a Motor, o la que la complemente o sustituya. En todo caso no se garantizan las secuelas incluidas en el “Capítulo especial - Perjuicio estético”.

    Asistencia sanitaria:

    • La prestación de los servicios médicos, quirúrgicos, hospitalarios y farmacéuticos, durante un periodo máximo de dos años desde la fecha del accidente ocurrido con la moto asegurada, derivados de los daños personales sufridos por el asegurado, en los centros clínicos y por los facultativos designados por la Entidad Aseguradora.
    • Los gastos de asistencia médica, quirúrgica, hospitalaria y farmacéuticos, durante un período máximo de un año desde la fecha del accidente ocurrido con la moto asegurada, derivados de los daños personales sufridos por el asegurado, en los centros clínicos y por los facultativos elegidos por el mismo.
    • Estancia y manutención de un acompañante: Los gastos de estancia y manutención de un acompañante en la misma localidad en que esté ingresado el ASEGURADO como consecuencia de un accidente garantizado.
    • Cirugía estética: Los gastos de la asistencia sanitaria destinados a corregir por vía quirúrgica los defectos estéticos que hayan quedado tras la curación, realizada dentro de los 12 meses siguientes a la misma, salvo prescripción facultativa que la retrase.
    • Prótesis: Los costes de la primera prótesis ortopédica, dental, óptica, acústica y marcapasos, necesaria con el fin de corregir las lesiones consecuentes del accidente garantizado.
    • Reparación o reposición de vestuario:
      • La reparación o reposición a valor de nuevo de la vestimenta del asegurado (incluido el casco), dañada como consecuencia de un accidente ocurrido con la moto asegurada.
      • No queda incluida la pérdida, sustracción o extravío de dichos bienes.
    • Los capitales asegurados son los siguientes:

      • Muerte: 18000 €
      • Invalidez permanente: Conforme a las normas de aplicación del Baremo, hasta 18000 €.
      • Asistencia sanitaria: Hasta 3000 € cuando la asistencia se preste al ASEGURADO en clínicas y por médicos de su libre elección y sin límite cuando la misma sea prestada por clínicas y médicos designados por la Entidad Aseguradora.
      • Estancia y manutención de un acompañante: Hasta 600 €.
      • Cirugía estética: Hasta 1.800 €, integrándose en el mismo todos los gastos médicos, quirúrgicos, hospitalarios y farmacéuticos.
      • Prótesis: Hasta 600 €.
      • Reparación/ reposición de vestuario: Hasta 300 €.

      Si una vez satisfecha la indemnización por Invalidez permanente, sobreviene el fallecimiento del ASEGURADO, dentro del plazo establecido para la cobertura del mismo y, en todo caso, como consecuencia de las lesiones sufridas en el accidente, se descontará de la indemnización por fallecimiento la cantidad ya satisfecha.

¿Qué no cubre la cobertura de Accidente al Conductor?

Además de las exclusiones generales de garantías voluntarias, quedan excluidos de la presente garantía los hechos que no tengan la consideración de accidente.

  • No se valorarán los perjuicios estéticos incluidos en el “Capítulo especial - Perjuicio estético”.
  • En ningún caso se tomará en cuenta la profesión del ASEGURADO, por lo que no podrá alegarse una agravación en la invalidez en base a la actividad profesional.
  • El sistema de puntuación de la invalidez resultante será el mismo que se establece en el mencionado Anexo, incluidas las normas establecidas en caso de incapacidades concurrentes.
  • No se considerarán secuela y, por tanto, lesión permanente, aquellos procesos que tengan curación a corto/medio plazo.
  • No se valorarán las secuelas que estén incluidas y/o se deriven de otra(s) secuela(s) aunque estén descritas de forma independiente en la tabla aplicable.
  • La puntuación de una o varias secuelas correspondientes a una articulación, miembro, aparato o sistema (en el caso de que sean varias secuelas tras utilizar la fórmula de incapacidades concurrentes) nunca podrá(n) superar a la que corresponda por pérdida total, anatómica y/o funcional de esta articulación, miembro, aparato o sistema.
  • Si un miembro u órgano afectado por un accidente presentaba con anterioridad al mismo amputaciones o limitaciones funcionales, el porcentaje de indemnización aplicable será la diferencia entre el de la invalidez preexistente y el que resulte después del siniestro.
  • En ningún caso podrán sobrepasarse los 100 puntos.

Cada punto obtenido por este sistema corresponde a un 1% del capital asegurado para esta garantía, por lo que la indemnización a percibir se corresponderá con los puntos obtenidos transformados en porcentaje, que en ningún caso pueden sobrepasar el 100% dicho capital asegurado.

La Entidad Aseguradora notificará por escrito al asegurado la cuantía de indemnización que le corresponde y si el asegurado no aceptase la proposición de la Entidad Aseguradora en lo referente al grado de invalidez, las partes se someterán a la decisión de peritos médicos, de acuerdo con el procedimiento pericial que se regula en apartado “La indemnización” de estas condiciones generales.

¿Qué cubre la cobertura de Asistencia Psico-emocional?

  • La asistencia psico-emocional al conductor, cónyuge, padres e hijos del conductor, en caso de sufrir este último una gran invalidez como consecuencia de un accidente de circulación ocurrido con la moto asegurada y cubierto por la póliza.
  • Se entiende por gran invalidez la situación del asegurado afecto de incapacidad permanente o lesiones que pudieran dar lugar a esta y que, como consecuencia de pérdidas anatómicas o funcionales, necesita la asistencia de otra persona para los actos más esenciales de la vida, tales como vestirse, desplazarse, comer o análogos.
  • Asistencia psico-emocional al cónyuge, padres e hijos:
    • En caso de fallecimiento del CONDUCTOR en ACCIDENTE DE CIRCULACIÓN cubierto por la PÓLIZA.
    • En el caso de fallecimiento y gran invalidez del cónyuge, padres e hijos del CONDUCTOR como ocupante de la moto asegurada en el momento del accidente.
    • Asistencia psico-emocional al CONDUCTOR en caso de Fallecimiento o Gran Invalidez de alguna persona que haya intervenido en el accidente.
  • Servicio asegurado: Asistencia psico-emocional con el límite de: 10 SESIONES

Las exclusiones generales de las garantías voluntarias y las de Accidentes del Conductor.

¿Qué es la cobertura de Asistencia en Carretera?

La asistencia en carretera cubre al asegurado cuando sufre un accidente o una avería dejándolo tirado antes de que llegue a su destino. Cuando pasa esto, Cleverea se encarga de enviar una grúa al punto donde el vehículo del asegurado ha quedado extraviado y llevarlo al taller de la elección del asegurado. Ofrecemos esta cobertura de manera opcional en el seguro del asegurado.

¿Qué cubre la cobertura de Asistencia en Carretera?

AYUDA TÉCNICA EN CARRETERA SI EL VEHÍCULO ASEGURADO SUFRE UN ACCIDENTE O AVERÍA, LA ENTIDAD ASEGURADORA LE OFRECE:

  • Si es posible una reparación de urgencia (duración inferior a una hora) del VEHÍCULO averiado que permitiera la circulación del mismo, la Entidad Aseguradora se hará cargo del coste de la reparación, excluyéndose el coste de las piezas sustituidas. Se incluye el pinchazo o reventón del neumático.

REMOLCAJE

  • Si el VEHÍCULO no puede circular por sus propios medios, la Entidad Aseguradora se hará cargo de los gastos de remolcaje hasta el taller elegido por el ASEGURADO con un límite de 100,0.

RESCATE

  • Rescate o salvamento del VEHÍCULO que, transitando por cualquier tipo de vía, no pudiera, por vuelco o caída en desnivel, circular o ser remolcado, hasta el importe máximo de 100,0.

ENVÍO DE PIEZAS DE RECAMBIO

  • Si la reparación precisara de piezas de recambio que no pudieran obtenerse en la zona de ocurrencia, la Entidad Aseguradora se hará cargo de su envío y de los correspondientes gastos de transporte.
  • El ASEGURADO, al término de su viaje, deberá reembolsar a la Entidad Aseguradora los anticipos que éste hubiese efectuado para la adquisición de piezas o el pago de derechos de aduana.
  • La Entidad Aseguradora no está obligado a esta prestación si las piezas solicitadas no se encuentran en España.

ENVÍO DE CHÓFER PROFESIONAL

  • Si el ASEGURADO se desplazaba en viaje conduciendo el VEHÍCULO ASEGURADO, y por causa de enfermedad grave, accidente o muerte, hubiese sido trasladado a un Centro de Hospitalización o estuviese incapacitado para conducir, sin que ningún otro ocupante del vehículo pudiera sustituirle en la conducción, la Entidad Aseguradora enviará un conductor profesional para transportar el vehículo y sus ocupantes hasta el domicilio del ASEGURADO o lugar de destino, a elección, siempre que los días a emplear en el traslado sean los mismos.
  • TRANSPORTE HASTA UNA DISTANCIA MÁXIMA DE 150 KM SI EL IMPORTE DE LA REPARACIÓN DE LOS DAÑOS DEL VEHÍCULO SUPERASE EL DE SU VALOR VENAL.

    • La información sobre el tiempo previsto de inmovilización y el coste de la reparación será proporcionada por el taller o servicio oficial donde haya sido remolcado el VEHÍCULO. En caso de discrepancia el ASEGURADO podrá solicitar, a su cargo, un presupuesto detallado.
    • Las condiciones del traslado serán decididas por la Entidad Aseguradora, así como el plazo de entrega del VEHÍCULO que en ningún caso podrá ser superior a 5 días hábiles dentro de territorio nacional no insular.
    • GASTOS DE ABANDONO LEGAL DEL VEHÍCULO

      • Cuando el VALOR VENAL del VEHÍCULO fuera inferior al coste de la reparación, la Entidad Aseguradora se hará cargo de los gastos que suponga el abandono legal del VEHÍCULO en el lugar donde se encuentre. De no ser posible dicho abandono, la Entidad Aseguradora se encargará de trasladar el VEHÍCULO al país donde pueda efectuarse.

      ASISTENCIA POR ROBO DEL VEHÍCULO (si se produce el robo del vehículo asegurado):

      • Si, como consecuencia del ROBO del VEHÍCULO, los ocupantes del mismo no pudieran regresar a su domicilio, la Entidad Aseguradora proporcionará el medio de transporte más idóneo para que puedan seguir su viaje, previa presentación de la denuncia del ROBO ante la autoridad competente.

      TRANSPORTE O REPATRIACIÓN DEL VEHÍCULO AVERIADO O ROBADO (si el vehículo asegurado no puede ser reparado en el día):

      • Si el VEHÍCULO accidentado o averiado no pudiera ser reparado en el día, o en caso de ROBO si el ASEGURADO hubiera regresado a su domicilio, la Entidad Aseguradora se hará cargo del:
        • Transporte hasta el taller designado por el ASEGURADO (en la localidad del domicilio declarado o, si no existiera, en la localidad más próxima al mismo).
        • También la Entidad Aseguradora se hará cargo de:
          • Los gastos de pupilaje o custodia generados por esta garantía hasta un máximo de 200 €.
          • La repatriación del remolque o caravana designados, con el límite de 200 €.

        PRESTACIONES A LOS ASEGURADOS EN CASO DE INMOVILIZACIÓN DEL VEHÍCULO POR AVERÍA O ACCIDENTE

        • Proporcionar a los ocupantes del VEHÍCULO, el medio de transporte público más idóneo para que puedan llegar a su domicilio o a su destino, siempre que el coste para llegar a este último fuera igual o inferior al coste para llegar a su domicilio. La Entidad Aseguradora sólo se hará cargo del coste de uno de los dos trayectos.
        • Facilitar un VEHÍCULO de alquiler para realizar el trayecto, con un límite de 150€, en función de la disponibilidad y siempre que el ASEGURADO acepte las condiciones del contrato de alquiler.
        • Los gastos de alojamiento por un importe de 100 € por ASEGURADO y día, con un máximo de 10 días por ASEGURADO si éste optara por esperar a que su vehículo fuera reparado en el lugar donde fue remolcado. El ASEGURADO no podrá alojarse en hotel cuando se encuentre a menos de 50 kilómetros de su domicilio.

        TRASLADO DEL ASEGURADO PARA RECOGER EL VEHÍCULO (una vez reparado el vehículo asegurado)

        • Cuando el VEHÍCULO haya sido reparado en el taller donde fue remolcado y, siempre que el ASEGURADO hubiera continuado su viaje a su domicilio o a su destino, la Entidad Aseguradora se hará cargo de:
          • Repatriar el VEHÍCULO ya reparado, para lo cual el ASEGURADO aceptará las condiciones de entrega mencionadas en “Transporte o Repatriación del vehículo averiado o robado”. Esta opción podrá ser aplicada en los casos en que el VEHÍCULO haya sido recuperado.
          • Proporcionar un medio de transporte público para el ASEGURADO u otra persona, que éste designe, para recogerlo. Siempre que sea posible, en función de la situación y de la disponibilidad, la Entidad Aseguradora ofrecerá un billete de avión en clase turista.

        OBTENCIÓN Y ENVÍO DE DUPLICADO DE LLAVES

        • Cuando se produzca la pérdida o ROBO de las llaves del VEHÍCULO ASEGURADO, la Entidad Aseguradora se hará cargo de hacer llegar un duplicado (si el ASEGURADO facilita el nombre de una persona y el lugar de envío) o de remolcar el VEHÍCULO hasta el servicio oficial más cercano al lugar de ocurrencia del siniestro.

        COMBUSTIBLE

        • Si el VEHÍCULO quedara inmovilizado por falta de combustible, la Entidad Aseguradora le facilitará el suficiente para que pueda llegar a repostar a una gasolinera próxima, o, según la disponibilidad, remolcará el vehículo hasta ésta. En cualquier caso, el coste del combustible irá a cargo del ASEGURADO.

        ¿En qué territorio me cubre?

        • En España, en el resto de Europa y países ribereños del Mediterráneo, desde el domicilio habitual del ASEGURADO (km 0)

¿Qué NO cubre la cobertura de Asistencia en Carretera?

Además de las exclusiones generales de garantías voluntarias, quedan excluidos de la presente garantía:

  • Las recaídas de enfermedades crónicas y las situaciones derivadas de padecimientos o condiciones previas al inicio del viaje.
  • La muerte por suicidio y las enfermedades o lesiones causadas intencionadamente por el ASEGURADO a sí mismo, así como las producidas por la ingestión de drogas o las derivadas de acción criminal del mismo.
  • Los tratamientos estéticos y todo tipo de lentes, prótesis y aparatos ortopédicos en general.
  • Los partos y las complicaciones de embarazos a partir del sexto mes, así como las revisiones obstétricas periódicas.
  • Las enfermedades mentales, así como las enfermedades y lesiones causadas intencionalmente por el ASEGURADO a sí mismo y las resultantes de acción criminal de aquél.
  • La participación en competiciones deportivas y el rescate de personas en montaña, mar o desierto.
  • Los gastos médicos, quirúrgicos, farmacéuticos y de hospitalización ocurridos en España a menos de 100 Km del domicilio del ASEGURADO.
  • Gastos de gasolina, reparaciones y piezas de recambio.
  • Accidentes personales producidos durante la práctica de cualquier actividad deportiva o entrenamientos.
  • Transporte de mercancías y animales.
  • Las prestaciones no solicitadas a la Entidad Aseguradora, salvo en casos de fuerza mayor o imposibilidad debidamente demostrada.
